Terms of Use
1. Agreement to these terms
These Terms of Use (“Terms”) are a legal agreement between you and Compound Pixels Pty Ltd, ABN 28 697 075 853, of PO Box 302, Mont Albert VIC 3127, Australia (“Save Genie”, “we”, “us”, “our”). They govern your use of the Save Genie apps for iOS and macOS (including the Share, Action, Safari and Chrome extensions and the App Clip), the getsavegenie.com website, and all related features and services (together, the “Service”).
By downloading, installing, signing in to, or using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, please do not use the Service.
2. Eligibility and age
- You must be at least 13 years old to use the Service. It is not offered to children under 13.
- If you are 13 to 17, you may use the Service only with the consent and involvement of a parent or legal guardian who agrees to these Terms on your behalf. Some features are age-gated: personalised advertising and Apple’s App Tracking Transparency prompt are limited to users 18 and over, and users under 18 receive only non-personalised ads where ads are shown.
- By using the Service you confirm that you meet these requirements and that the information you give us is accurate.
3. Your account
- The Service requires you to sign in (currently with Sign in with Apple). Save Genie works offline-first: once you are signed in, your data is stored on your device and synced to our cloud so it stays consistent across your devices.
- You are responsible for your account and for activity under it, and for keeping your information accurate.
- You can delete your account at any time in the app (Settings → Profile → Delete Account), which removes your data from our cloud, subject to the limited exceptions described in the Privacy Policy (see “How long we keep your information”).
- We may suspend or terminate accounts that breach these Terms or harm the Service, other users, or third parties (see section 12).
4. What Save Genie does
Save Genie lets you save products from any online store and tells you when prices change. Core features include:
- Saving products from any store, via a shared link, the in-app paste and clipboard flow, the Share and Action extensions, the Safari and Chrome browser extensions, and, on macOS, browser-tab import. When you save a link, the app automatically reads product details such as title, price, image, brand and availability.
- Price tracking and notifications: the app periodically re-checks saved products, keeps a price history for each item, and can send you price-drop, availability and cross-store notifications, according to your settings.
- Find: search for a product across stores from inside the app, open a retailer’s product page in Save Genie’s built-in viewer, and save it from there. On the Free tier, watching a rewarded ad unlocks a batch of Find searches.
- Collections, including shared collections you can invite others to, with reactions and purchase marks.
- Photos attached to products or collections.
- Cross-store matching to surface the same product at other retailers, where available.
- Widgets (iOS) and a macOS app for Premium users.
Product and price data is provided “as is”. Save Genie reads product data automatically from third-party retailer websites and cloud extraction services. That data may be inaccurate, incomplete, delayed, out of date, or wrong (because of site changes, regional pricing, currency, product variants, promotions, or extraction errors). It is not an offer, quote or guarantee by Save Genie or any retailer, and it forms no part of any contract of sale. Always check the price on the retailer’s own website before you buy.
Save Genie is not a retailer, marketplace, agent, or party to any transaction between you and a store. Any purchase is solely between you and that retailer, on the retailer’s terms. We are not responsible for retailers, their products, prices, availability, delivery, or conduct, and price-drop notifications are informational only: we do not guarantee any price or saving, or that a notification will be delivered.
5. Your content
- Ownership. You keep ownership of the content you create: saved products and notes, collections, “thought” cards, photos, your display name, and avatar (“Your Content”).
- Licence to us. You grant Save Genie a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt and display Your Content solely to operate and improve the Service, including syncing it across your devices, generating notifications, and, where you choose, sharing it with members of a collection you take part in.
- Shared collections. Members of a collection you share or join can see its items, your name and avatar, and your reactions within that collection. You are responsible for what you share and must have the right to share it. (Surprise gift lists deliberately hide reactions and purchase marks from the recipient.)
- Responsibility. You confirm that Your Content does not infringe anyone’s rights or any law. We may remove content that breaches these Terms.
6. Acceptable use
You agree not to:
- use the Service for any unlawful, infringing, deceptive or harmful purpose;
- upload content that is illegal, infringing, defamatory, obscene, or that violates another person’s privacy or intellectual-property rights;
- attempt to gain unauthorised access to, disrupt, overload, reverse-engineer, scrape, or interfere with the Service, our servers, or our extraction infrastructure;
- get around rate limits, entitlement gates, or usage restrictions (for example, the Free item limit, the daily add allowance, rewarded-ad unlocks, cloud-extraction limits, or Premium gating);
- use the Service to build or train a competing product, or to resell or redistribute the Service or its data; or
- misuse shared collections, invites, or reactions to harass, deceive, or spam other users.
7. Free and Premium: subscriptions and billing
Save Genie offers a Free tier and an optional Premium subscription.
Free includes price tracking and notifications for up to 20 saved items, with up to 3 new items a day (this daily allowance resets at the start of each day, local time). Collections and sharing are unlimited, and price history is included at no cost. Free users on iOS may see ads (see section 8), and some cloud extractions are usage-limited. Watching a rewarded ad unlocks some extras for a while: the “Found in other stores” view (for the session) and a batch of Find searches (up to a daily maximum shown in the app).
If you reach the 20-item limit, the items you have already saved are kept and keep being tracked; you simply cannot add new items until you remove some to get back under the limit, or upgrade to Premium.
Premium removes the item limit and the daily add allowance, removes ads, and adds the macOS app and the iOS Home Screen widget, along with unlimited cloud extraction (subject to fair-use budget caps). Premium users see no rewarded ads for Find or “Found in other stores”. The macOS app requires Premium.
Pricing. Current prices for Premium (including the available billing periods) are shown in the app and on our App Store listing. Prices are set through the App Store and vary by region and currency, and the exact price is always shown to you before you confirm a purchase.
- Billing is handled by Apple through the App Store (StoreKit), not by us. Purchases are charged to your Apple Account. We do not receive or store your payment-card details.
- Auto-renewal. Subscriptions renew automatically at the then-current price unless you cancel at least 24 hours before the end of the current period. Manage or cancel in your Apple Account settings. Deleting the app does not cancel a subscription.
- Entitlement. Premium status is verified with Apple and may take a moment to sync across your devices. Feature availability may change over time.
- Refunds are handled by Apple under App Store policy and applicable law; we generally cannot issue refunds directly.
- Nothing here limits your rights under the Australian Consumer Law or other consumer-protection laws that cannot be excluded (see section 10).
8. Advertising and affiliate links
- Ads (iOS only). Free users on iOS may see ads served through Google AdMob. These can appear as a banner, as sponsored cards among your saved items, as occasional full-screen ads, and as rewarded ads you choose to watch to unlock a feature. Premium users see no ads, and macOS has no ads at all. Advertising and tracking permissions are handled through the in-app consent flow (Apple’s App Tracking Transparency and, where it applies, GDPR consent).
- Affiliate links (coming soon). Some outbound retailer links may be affiliate links, meaning we may earn a commission if you buy, at no extra cost to you and without affecting the prices you are shown. This is not active in the current release; we will update these Terms before turning it on.
9. Third-party services and content
The Service relies on third-party providers (including Apple, our cloud database and storage provider, our data-extraction provider, our email provider, and our advertising provider) and links to third-party retailer websites. We do not control and are not responsible for third-party services, websites, or content; your use of them is subject to their own terms and privacy policies. These providers, and how we share data with them, are described in the Privacy Policy.
10. Disclaimers and consumer guarantees
To the maximum extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, including as to the accuracy of price or product data, availability, uninterrupted or error-free operation, delivery of notifications, or fitness for a particular purpose.
Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, or any other law that cannot lawfully be excluded. Where it can be limited, our liability for failing to comply with a consumer guarantee is limited, at our option, to re-supplying the relevant service or paying the cost of having it re-supplied.
11. Limitation of liability
To the maximum extent permitted by law, and subject to section 10:
- Save Genie will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, savings, data or goodwill, arising out of or relating to your use of the Service, including any reliance on price or product information or on a notification.
- Our total liability for all claims relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim, or A$100.
- The cap above does not apply to, and nothing in these Terms limits, our liability arising out of our fraud (including fraudulent misrepresentation), our breach of any applicable law, or our infringement of your intellectual property rights.
12. Suspension and termination
- You can stop using the Service and delete your account at any time.
- We may suspend, restrict or terminate your access where it is reasonable to do so, for example if you seriously or repeatedly breach these Terms, if the law requires it, or where it is reasonably necessary to protect the Service, other users, or third parties. Unless it is impractical (for example, in an emergency, or where notice would compromise security or an investigation), we will give you notice and a reasonable chance to fix the problem first.
- Provisions that by their nature should survive (including sections 5, 10, 11, 13 and 14) continue after termination.
13. Changes to the Service and to these Terms
We are always improving the Service and may add to or refine features over time. If we plan to make a material change to these Terms, to discontinue the Service, or to make a change that materially reduces the Service, we will give you at least 30 days’ notice before the change takes effect, in the app or by email, and by posting the updated Terms with a new “Last updated” date. We may make minor changes (for example, correcting errors, clarifying wording, or updating terminology) by posting the updated Terms with a new “Last updated” date, without separate notice. A shorter notice period may apply to a material change only where it is required by law or is reasonably necessary to address a security or safety risk.
If you do not agree to a change, you can stop using the Service, delete your account, and cancel any subscription through your Apple Account before the change takes effect. If you keep using the Service after a change takes effect, you accept it.
14. Governing law and disputes
These Terms are governed by the laws of Victoria, Australia, and you and Save Genie submit to the non-exclusive jurisdiction of the courts of that place, without limiting any right you have to bring proceedings in your local jurisdiction where the law requires it.
15. General
- Entire agreement. These Terms and the Privacy Policy are the entire agreement about the Service.
- Severability. If any provision is unenforceable, the rest stay in effect.
- No waiver. If we do not enforce a provision, that is not a waiver of it.
- Assignment. You may not assign these Terms; we may assign them in a merger, acquisition, or sale of assets.
- Apple. These Terms are between you and Save Genie, not Apple. Apple is not responsible for the Service, but is a third-party beneficiary entitled to enforce these Terms against you, and Apple’s App Store terms also apply.
